We know businesses rely on your software and you can rely on us when things go wrong.

What you need to know about insurance for software companies

What you need to know about insurance for software companies

The pace of technological change is frightening and as we become more reliant on technology, small problems can become big problems for technology companies, even bringing them to a standstill.

We know your clients are reliant, if not dependent on your service, and that their expectations are higher than ever before. If things go wrong, your clients are not afraid to point their finger in your direction.

More than ever, you need insurance to cover you against the wide range of risks you face. It has to be the right insurance and while there are plenty of insurance companies willing to insure software companies, very few understand your industry and very few will cover your key risks.

What insurance do you offer IT and Sofware companies?

So our IT and software clients are all very different. We have for example consultancy, IT consultancy businesses, IT software support businesses, software maintenance, software as a service provision, uh, provision of contract staff and consultants and mission critical software. We cannot stress enough the importance of working with your insurance broker and for them to understand what can go wrong and organizing a policy to cover your needs. What are your true exposures as an IT business?

What are the common claims against IT and Software companies?

So this this goes back to the first question. It really depends on what your IT or software business does. So it could be server downtime. It could be hacker attacks. It could be simple software malfunctions where the software doesn’t work as it should, or it could simply be failing to meet a contractual provision with your clients.

Um, one of the common claims we see with software companies is the sales team and client, the sales team think the software should look like X. Uh, the client believes the software should look like Y and the software developers develop a piece of software that looks like Z. Um, so at the end there’s this situation where the parties come together and there’s a disagreement about the software that’s been developed.

Um, another area we see with with not just software companies but, but, IT businesses is what we call project creep, where the project doesn’t hit the key milestones. And that’s often not just a result of, of, your team not hitting those milestones, but it’s a result of the, the, client changing their requirements or adding on extra bits and as a result those milestones aren’t hit.

Um in terms of the insurance, we can’t stress the enough the importance of breach of contract cover within your insurance policy. Unlike traditional negligence claims, with IT businesses, it’s unlikely you will get a claim which, which, is simply your client alleging you’ve made a mistake. It’s far easier for the client to bring a claim under a breach of contract and, and, they will allege that you failed to hit 99.9% uptime or that you failed to hit a key milestone or your software’s failed to do what’s specified within the contract. So check your insurance policy, check that it includes breach of contract cover.

What you need from professional indemnity

Professional indemnity is the most important cover you need.

Generic or miscellaneous professional indemnity insurance policies will often exclude the key risks you face. You need to make sure you’re cover includes:

Breach of contract

Very few software companies proceed with a job without a contract and it’s critical you understand how that contract affects your liability and importantly if your professional indemnity will protect you if things go wrong.

Breach of contract is often excluded or restrictive but you can sometimes source an alternative policy including breach of contract cover at no extra cost.

Warranties

Often claims against IT companies are brought as a ‘breach of warranty’ but many insurance companies don’t understand this, so will only cover you for claims if it can be proven that you made an error.

Sometimes, you will have taken all the reasonable care and skill but still breach a warranty agreement. If that happens, you need the peace of mind you are covered. We can arrange cover for you that extends to cover breaches of a warranty of quality, a warranty of reasonable care and skill, or a warranty to conform to a written specification.

Avoiding claims

If a client makes a complaint about your work, we know the last thing you need is an expensive legal fight. With specialist technology lawyers to hand, it’s often possible to avoid a claim or lawsuit all together.

If you’re buying professional indemnity, check whether the insurance company has their own in-house legal team, or if not, what law firms they outsource to because a specialist technology lawyer is worth their weight in gold.

We only arrange insurance with specialist insurers with in-house specialist technology lawyers. The professional indemnity policy we provide also includes an ‘avoiding a claim’ extension.
