What you need to know about insurance for AI companies

The boom of artificial intelligence (AI), machine learning, chatbots and large language models has taken some insurance companies by surprise.

When they see an enquiry from a startup in this sector many insurers are surprised and unprepared. AI, machine learning, chatbots and large language models are no longer the preserve of major tech giants like Meta, Google and Microsoft. We know that easily accessible AI open-source code that is commercially available has triggered a boom in insurance enquiries linked to AI and Meta’s decision to make its source code available will only accelerate this growth.

We are excited by the enquiries we get, from the small, bread-and-butter deployment like chatbots for commercial websites, right through to sophisticated uses such as AI in the medical industry. Potential uses are endless and whilst there are some insurable risks similar to those of other software companies, some exposure will differ.

Traditional risks facing software companies are failure of the software to perform its intended function and inaccessibility or allegations of inaccessibility due to outages or downtime. The AI industry faces very similar risks: failure of the AI to work as intended, especially where a contract includes guarantees on performance; and if AI software is provided as a software as service (SAAS) and hosted in the cloud, like any SAAS company, the AI company will be liable for allegations of inaccessibility due to outages or downtime.

However, we know AI companies are unique and have specific insurance needs, especially if you use open-source code because you need to ensure your licence agreements allow commercial activity and that the intended use is permitted.

What is AI software insurance?

Insurers are racing to release AI-branded insurance products, but we sense the final outcome of that race is likely to simply be the re-design of SAAS insurance products as AI insurance products.

Whilst that race continues, the cover provided by a specialist technology or software insurance provider should cover the main exposures, including but not limited to breach of intellectual property, breach of client contracts, breach of confidentiality, and allegations of non-performance (errors and omissions).

As a specialist broker, we’re most concerned about ‘open and honest’ declarations to insurers. We know AI companies sometimes have a generic software policy, with the insurance provider unaware the company is involved in AI. Many insurers deem this risk to be ‘material’ and would expect specific declaration that the company is involved in artificial intelligence, machine learning or large language models. Documentation that only states ‘software’ is too generic, and insurers could feel it’s misleading in the presentation of the risk, increasing the likelihood of a claim, which is why we’ll always be specific about what your company is and what it does.

AI Insurance

You need cover because emerging technology comes with emerging risks and the legal landscape surrounding AI companies is still in its infancy. This brings opportunity and competition but also litigation.

With new technologies there are always growing pains, increasing the chances of complaints by clients and legal disputes.

Our tailored insurance packages provide AI companies with essential legal protection and support if things go wrong.

  • Professional indemnity insurance – This is crucial. It covers you for allegations of mistakes and negligence. It provides compensation to your client (or a third-party) in circumstances where you are liable due to professional negligence, and usually covers associated defence or legal costs.
  • Cyber insurance – This mustn’t be underestimated. Even the largest companies can be hacked. You know IT security better than most but it only takes a small oversight for your systems to be compromised. We provide specialist support and our insurance will get your business back on its feet quickly if the worst happens.
  • Public and product liability – This covers physical injury and damage and can be added to packages at a low cost.
  • Employers’ liability – This will protect you from legal costs should an employee sustain a bodily injury in the course of their employment. If you have any employees it is compulsory in the UK to have employers’ liability and it can be added to packages at a low cost.
  • Computers, laptops and office equipment – We advise insuring your IT equipment from theft and destruction and can offer cover for portable IT on a worldwide basis.
  • Directors’ and officers’ insurance – This covers claims against directors or senior managers made in a personal capacity and is especially relevant if you have external investors who could hold company directors liable for failures or missed targets.

We know your industry faces similar risks to software companies and other emerging technologies. That means:

  • Traditional negligence, non-compliance and non-performance claims – Allegations by your client that the AI technology designed is not returning the correct or accurate results.
  • Breach of contract – Allegations the AI software fails to meet the contractual provisions, including matters such as missed deadlines and failure to meet uptime requirements.
  • Breach of intellectual property (IP) – Allegations you have copied the code or IP of another firm in the design of your AI technology.
  • Cyber-attacks – Incidents affecting either your systems or your client’s (where you are liable).
  • Counter claims and tactical litigation – Increasingly claims are being made tactically, for instance, by clients with cash flow challenges who make unfounded allegations in a bid to get your business to write off or reduce genuine invoices.
  • If you have American or Canadian clients or contracts, they will probably be excluded and some insurers will restrict cover to UK claims only. However, policies can be extended to include USA and Canada protection for an additional premium.
  • Most policies will exclude any claims related to patents. In the software sector, you may not need it, but we can explore additional coverage if you do.
  • Deliberate acts, dishonest or fraudulent acts are usually excluded unless committed by an employee without the knowledge of senior management.
  • Disputes which are purely commercial in nature and not linked to your supply or service provision, such as a commercial dispute with a supplier may be excluded. Disputes with clients are usually covered, especially if they allege your business has been negligent or breached a contract.

We can cover any business involved with AI technology, large or small and regardless of specialism and we work with insurers that will consider AI technology related to higher-risk industries like health and financial services too.

elements that can be included in your Technology insurance package

Professional indemnity for AI companies

Professional indemnity covers you for allegations of mistakes and errors. In AI that is usually claims that the AI has provided incorrect information or completed a function or task incorrectly. AI companies will also face more traditional allegations related to software failures or glitches, server downtime, breach of warranties or uptime agreements, or breach of contract.

These risks will only be covered by a specialist AI product. Some insurers provide negligence-only policies, which will often exclude the key risks you need. A specialist AI product will also include breach of confidentiality and breach of intellectual property, which can protect from claims from third parties as well as clients.

Professional Indemnity
Cyber Insurance

Cyber insurance for AI companies

Cyber insurance will cover costs associated with a cyber-attack. These can include legal fees, IT forensic costs, IT rebuild or restoration costs, costs associated with notifying data subjects and lost revenue during downtime.

Office insurance for AI companies

Office insurance is usually a combined policy, covering your business property in the office, laptops and employers and liability insurance.

It can also be extended to include business interruption which covers the loss of income and/or additional costs while your business is out of action.

Office Insurance
Directors & Officers Insurance

Directors’ and officers’ insurance for AI companies

Directors’ and officers’ insurance provides defence costs and monetary settlements in cases of claims made against company directors and senior managers. Complainants can include shareholders, regulators, or other third party stakeholders.

Directors’ and officers’ insurance usually excludes claims from clients related to advice provided by the business. Instead, this typically falls under the professional indemnity insurance module.
